1. Purpose of Guardian Home Program
This Guardian Home Agreement ("Agreement") is entered into between Twin Oak Goldendoodles ("Breeder") and the individual named above ("Guardian"). The Guardian Home Program allows select breeding dogs owned by the Breeder to live in a loving, permanent home while remaining available to the Breeder for a limited and defined breeding purpose.
The Guardian agrees to provide a safe, stable, and caring home for the dog while supporting the Breeder’s breeding program in accordance with the terms of this Agreement.
2. Description of Guardian Dog
The dog subject to this Agreement ("Guardian Dog") is described as follows:

The Guardian Dog shall remain the sole property of the Breeder until all terms of this Agreement have been fully satisfied and ownership is formally transferred.
3. Term of Agreement and Breeding Commitment
Females: Guardian Dog is contracted for three (3) to four (4) litters, contingent upon health and veterinary clearance.
Males: Guardian Dog is contracted for up to five (5) years of stud service, contingent upon health and fertility.
The first breeding must occur within two (2) years of the Effective Date of this Agreement unless otherwise agreed to in writing. Failure to complete a breeding within this timeframe may result in termination of this Agreement and return of the Guardian Dog to the Breeder.
Upon completion of the breeding obligation, the Breeder shall arrange and pay for spay or neuter of the Guardian Dog and transfer full ownership to the Guardian.
All puppies produced and/or semen collected during the term of this Agreement are the sole property of the Breeder.
4. Breeder Responsibilities
During the term of this Agreement, the Breeder agrees to:
Provide a healthy, well-socialized puppy.
Provide dietary, vaccination, and general care guidelines.
Maintain reasonable contact with the Guardian, including virtual check-ins or scheduled home visits.
Pay for all breeding-related veterinary expenses, including genetic testing, OFA/PennHIP evaluations, and reproductive care.
Pay for spay or neuter upon completion or termination of the breeding obligation.
Provide education regarding heat cycles, breeding timing, and pregnancy expectations.
Take possession of the Guardian Dog when required for breeding, whelping, or related care.
Accept return of the Guardian Dog at any time if the Guardian is no longer able to fulfill their obligations.
5. Guardian Responsibilities
The Guardian agrees to:
Provide a safe indoor home environment and humane care.
Feed a high-quality diet appropriate for the dog’s age and size.
Maintain routine veterinary care, including vaccinations, parasite prevention, and wellness exams at the Guardian’s expense.
Notify the Breeder immediately of illness, injury, or non-routine veterinary visits.
Keep the Guardian Dog securely contained at all times and prevent accidental breeding.
Notify the Breeder of each heat cycle (for females) from the first heat onward.
Provide basic obedience training and proper socialization.
Keep the Guardian Dog well groomed and professionally groomed as needed.
Deliver the Guardian Dog to the Breeder with 24 hours’ notice when requested for breeding or testing.
Never sell, lease, rehome, or transfer the Guardian Dog without written consent from the Breeder.
6. Accidental Breeding
Any accidental breeding must be reported to the Breeder within 24 hours. Failure to report may result in liquidated damages of $5,000, which both parties agree is a reasonable estimate of damages.
All puppies resulting from an accidental breeding are the sole property of the Breeder and do not count toward contracted litters.
7. Removal or Return of Guardian Dog
The Breeder may temporarily or permanently remove the Guardian Dog for non-compliance with this Agreement or concerns regarding the dog’s health or safety.
The Guardian may return the Guardian Dog to the Breeder at any time, terminating this Agreement, with no financial compensation owed to either party.
8. Death of Guardian Dog
If the Guardian Dog dies due to natural or accidental causes not involving negligence, this Agreement shall terminate with no further obligation.
If a female Guardian Dog dies during whelping, the Breeder shall provide the Guardian with a spayed or neutered puppy from that litter, if one survives to eight (8) weeks of age.
9. Image and Media Rights
The Breeder retains rights to all professional images of the Guardian Dog. The Guardian may share images posted by the Breeder for personal use only.
10. Confidentiality
Any disputes arising under this Agreement shall remain confidential and shall not be discussed publicly or on social media.
11. Governing Law and Jurisdiction
This Agreement shall be governed by the laws of the State of Tennessee. Any legal action shall be brought exclusively in Gibson County, Tennessee. The parties waive the right to trial by jury.
12. Entire Agreement
This document constitutes the entire Agreement between the parties and may only be amended in writing and signed by both parties.
13. Acknowledgment and Signatures
By signing below, both parties acknowledge they have read, understand, and agree to all terms of this Agreement.
