Twin Oak Goldendoodles Puppy Purchase Agreement and Health Warranty

2. Seller’s Health Warranty and Conditions

Initial Veterinary Exam:
Buyer agrees to have the dog examined by a licensed veterinarian within five (5) days of receiving the dog. Any claim for return must be submitted within this time and accompanied by a written report from the veterinarian documenting the issue.

Genetic Health Warranty:

• The dog is covered under a two-year warranty against genetic defects related to the hips, heart, elbows, patella, eyes, or other life-threatening issues.

• Reimbursement is limited to 50% of the purchase price or a replacement puppy.

• Reimbursement requires a second opinion from a qualified veterinarian and proof of surgical or treatment costs. An official OFA hip rating qualifies as a second opinion.

• Umbilical hernia repairs are reimbursed up to $200.

• In the event of the dog’s death before age 2 due to a genetic issue, a replacement puppy will be provided at no cost. A necropsy report confirming a genetic cause is required.

• Shipping fees are the responsibility of the buyer.

• Warranties apply only to the original purchaser and are void upon transfer of ownership.

• The Seller makes no guarantee regarding shedding, allergic reactions, or adult size and coat type.

Trupanion Health Insurance:
Twin Oak Goldendoodles provides 30 days of complimentary health insurance through Trupanion. Buyer must activate coverage within 24 hours of taking possession. Within the first 30 days, warranty issues will only be reimbursed up to the amount of the Trupanion deductible.

3. Spay/Neuter Requirement

This dog is sold strictly as a pet and not for breeding.

• Dog must be spayed or neutered by 12 months of age.

• Proof of the procedure must be submitted to Twin Oak Goldendoodles within 30 days of completion.

• Failure to do so will void the health warranty and subject the Buyer to a penalty of five (5) times the purchase price.

• If this dog is bred, Buyer agrees to pay ten (10) times the purchase price per litter produced.

• All legal fees incurred to enforce this contract will be the responsibility of the Buyer.

4. Limitations of Liability

The Seller is not liable for:

• Any injury, illness, or death resulting from abuse, neglect, accidents, or misuse of the dog.

• Any consequential, incidental, or special damages related to the dog.

• Any condition resulting from the use of oral flea/tick preventatives or injectable heartworm preventatives such as ProHeart 6 (which voids the warranty per FDA concerns).

Upon signing this agreement, all veterinary care and associated costs become the sole responsibility of the Buyer.

5. Purchase Price and Consideration

Should payment be dishonored or not collectible (e.g., bounced check), Buyer is responsible for all legal and collection costs, including attorneys' fees.

6. Care and Maintenance Agreement

Buyer agrees to:

• Maintain the dog in good health and a healthy weight.

• Provide routine veterinary care, including vaccinations, deworming, and heartworm prevention.

• House the dog indoors and feed a high-quality diet.

• Avoid excessive physical activity (e.g., agility, long runs) until the dog reaches at least 12 months of age.

• Provide basic obedience training within the first year.

• Never surrender the dog to a shelter, research lab, or similar facility.

7. Confidentiality of Disputes

In the event of a dispute, both parties agree to keep the details and existence of the dispute confidential. This includes not discussing it publicly or on social media. However, this does not prevent either party from pursuing legal action or participating in private, confidential mediation.

8. Full Agreement and Jurisdiction

This document represents the entire agreement between the Buyer and Seller. No other verbal or written agreements outside of this contract are valid unless both parties sign a written amendment.

This contract will be governed by the laws of the State of Tennessee. Any legal disputes will be handled in the courts of Gibson County, Tennessee.
